Introduction

Welcome to NewPickLee Inc. DBA Fursana (Fursana, “we”, “our”, or “us”). Fursana provides an electronic pet health record system and platform to facilitate the storage, management, and access of pet medical data for veterinary hospitals, pet owners, and related users (the “Services”).

By accessing or using our Services, including our website, mobile application, and integrated software tools (collectively, the “Platform”), you (“User”, “you”, or “your”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not access or use our Services.

1. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our Services. If you are using the Services on behalf of a company, veterinary practice, or organization, you represent and warrant that you are authorized to bind such entities to these Terms.

2. Medical Emergencies

MEDICAL EMERGENCY
THE ELECTRONIC SERVICES SHOULD NOT BE USED IN ANY URGENT OR EMERGENCY SITUATIONS. IF YOU THINK YOUR PET MAY HAVE A MEDICAL EMERGENCY OR MAY NEED URGENT MEDICAL ATTENTION, CALL YOUR VETERINARIAN OR AN EMERGENCY VETERINARY PROVIDER IMMEDIATELY.

3. User Accounts

To use certain features of the Platform, users must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your login credentials.
  • Notify us immediately of any unauthorized use or security breach.
  • Be responsible for all activity under your account.

4. Website Usage

You agree to the following when accessing or using the Fursana website:

  • Do not cause damage or impair accessibility of the Platform.
  • Do not use the website unlawfully or harmfully.
  • Do not copy or use content for commercial purposes without permission.
  • Do not attempt unauthorized access to any part of the Platform.

5. Data and Privacy

Our collection and use of data is governed by our Privacy Policy. By using the Services, you consent to the described data practices.

You retain ownership of data you input. You grant us a limited license to process the data solely for service provision and improvement.

6. Data Removal Policy

To request deletion of your data, contact us at hello@fursana.com. We will handle your request in accordance with applicable laws. Some data may need to be retained for legal or operational purposes.

7. Veterinary Practice Responsibilities

Veterinary providers agree to:

  • Use Services in compliance with applicable laws.
  • Handle pet owner data securely.
  • Obtain necessary consents before uploading/sharing information.

8. Prohibited Conduct

You may not:

  • Use the Services unlawfully or fraudulently.
  • Upload infringing material.
  • Interfere with the Platform.
  • Use unauthorized automated means to access Services.

9. Intellectual Property

All Platform content and features (excluding user data) are owned by Fursana or its licensors. Do not copy, modify, or distribute without permission.

10. Third-Party Services

Fursana integrates third-party services. We are not responsible for their content or practices. Use them at your own risk.

11. Disclaimers

Services are provided 'as-is' and 'as available'. We disclaim all express or implied warranties including merchantability and fitness for a particular purpose.

12. Limitation of Liability

To the extent permitted by law, Fursana is not liable for indirect, incidental, or consequential damages including data loss or lost profits.

13. Indemnification

You agree to indemnify and hold harmless Fursana from claims and expenses resulting from your use of the Services or violation of these Terms.

14. Termination

We may terminate or suspend your access to the Services at any time. Upon termination, you must stop all use of the Platform.

15. Changes to Terms

We may modify these Terms and will notify users of material changes. Continued use constitutes acceptance of updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware. Disputes shall be resolved in the courts located in New Castle County, City of Newark Delaware.
